1. Про Застосунок

Dyvo Budget — це застосунок для особистих фінансів, який дозволяє обліковувати рахунки, транзакції, підписки, категорії та бюджети, переглядати звіти й за бажанням ділити бюджет з іншими людьми. Фінансові суми вводите ви; Застосунок не підключається до банків і не переміщує реальні кошти.

2. Вимоги до користувача

Вам має бути щонайменше 13 років (або досягнуто мінімального віку цифрової згоди у вашій країні), і ви маєте бути здатні укласти обов'язкову угоду, щоб користуватися Застосунком.

3. Ваш обліковий запис

Ви можете користуватися Застосунком як гість або увійшовши через Apple чи Google. Ви відповідаєте за дії, що відбуваються під вашим обліковим записом, і за збереження безпеки свого способу входу. Ви відповідаєте за точність інформації, яку вводите.

4. Безкоштовні та Pro-функції

Застосунок пропонує безкоштовні функції та платне оновлення Dyvo Budget Pro. Безкоштовні функції включають особистий бюджет, ручні транзакції, рахунки, категорії, підписки та звіт за поточний місяць. Pro відкриває додаткові можливості, як-от спільні бюджети та розширені звіти. Ми можемо змінювати, які функції є безкоштовними чи Pro, але не позбавимо вас доступу до Pro-функцій, які ви вже сплатили, протягом оплаченого періоду.

5. Підписки, покупки та автоматичне поновлення

Dyvo Budget Pro доступний як підписка з автопоновленням або як разова покупка, що продаються через Apple App Store. Назви, тривалість та приклади цін:

* Ціни наведені в доларах США як приклад. App Store автоматично відображає та списує фактичну ціну у вашій локальній валюті, яка може відрізнятися, плюс застосовні податки.

До підписок з автопоновленням застосовуються такі умови, відповідно до вимог Apple:

• Оплата списується з вашого Apple Account при підтвердженні покупки.
• Автопоновлення: підписка автоматично поновлюється на той самий період за тією самою ціною, якщо автопоновлення не вимкнено щонайменше за 24 години до завершення поточного періоду.
• Списання за поновлення: з вашого Apple Account списується оплата за поновлення протягом 24 годин до завершення поточного періоду за ціною обраного плану.
• Керування та скасування: ви можете керувати підпискою та вимкнути автопоновлення в налаштуваннях свого Apple Account (Налаштування → ваше ім'я → Підписки) після покупки.
• Пробний період: якщо пропонується безкоштовний пробний період, його невикористана частина анулюється, коли ви купуєте підписку, що охоплює той самий контент.
• Разова покупка: опція Pro назавжди — це одна незношувана (non-consumable) покупка, яка не поновлюється й не списується повторно.

Повернення коштів за покупки в App Store здійснює Apple відповідно до своїх правил; запити подаються через Apple. Відновлення покупок доступне в Застосунку через «Відновити покупку».

6. Ліцензія

За умови дотримання цих Умов ми надаємо вам обмежену, невиключну, без права передачі, відкличну ліцензію на використання Застосунку на будь-якому пристрої Apple, яким ви володієте або який контролюєте, у межах, дозволених Умовами обслуговування Apple App Store («Правила використання»). 7. Прийнятне використання

Ви погоджуєтеся не: (a) використовувати Застосунок у незаконних цілях; (b) здійснювати зворотну розробку, декомпіляцію чи спроби видобути вихідний код, окрім випадків, дозволених законом; (c) втручатися в роботу Застосунку чи його серверів або порушувати її; (d) намагатися отримати доступ до даних інших користувачів; (e) завантажувати контент, що є незаконним або порушує права інших.

8. Контент користувача та спільні бюджети

Ви зберігаєте право власності на дані, які вводите. Ви надаєте нам обмежене право зберігати, обробляти й синхронізувати ці дані виключно для роботи Застосунку для вас. Якщо ви користуєтеся спільними бюджетами, ви відповідаєте за те, чим ділитеся, і за запрошення лише тих людей, яким довіряєте; контент у спільному бюджеті видимий його учасникам.

9. Інтелектуальна власність

Застосунок, його дизайн і контент (окрім ваших даних) належать нам і нашим ліцензіарам та захищені законодавством про інтелектуальну власність. Ці Умови не надають вам жодних прав на наші торговельні марки чи брендинг.

10. Не є фінансовою порадою; відмова від гарантій

Dyvo Budget — це інструмент для обліку ваших власних фінансів. Він не надає фінансових, інвестиційних, податкових чи юридичних порад, а його звіти й розрахунки мають лише інформаційний характер. Конвертація валют спирається на курси третіх сторін і може бути неточною. Застосунок надається «як є» та «як доступно», без будь-яких гарантій, прямих чи непрямих, у максимально дозволеному законом обсязі, включно з будь-якими непрямими гарантіями товарної придатності, придатності для певної мети та невпорушення прав.

11. Обмеження відповідальності

У максимально дозволеному законом обсязі ми не несемо відповідальності за будь-які непрямі, випадкові, особливі, побічні чи штрафні збитки, а також за втрату даних, прибутку чи заощаджень, що виникають унаслідок використання (або неможливості використання) Застосунку. Наша сукупна відповідальність за будь-якою претензією щодо Застосунку не перевищить суми, яку ви сплатили нам за Застосунок протягом 12 місяців до претензії. 12. Припинення

Ви можете припинити користування Застосунком у будь-який час. Ми можемо призупинити або припинити ваш доступ, якщо ви порушуєте ці Умови чи зловживаєте Застосунком. Положення, які за своєю природою мають зберігати чинність після припинення (зокрема право власності, відмова від гарантій та обмеження відповідальності), залишаються чинними.

13. Зміни до цих Умов

Ми можемо час від часу оновлювати ці Умови. Істотні зміни набувають чинності після публікації оновлених Умов та оновлення дати «Останнє оновлення»; продовження користування Застосунком означає вашу згоду з ними.

14. Застосовне право

Ці Умови регулюються правом країни, де зареєстрований розробник, без урахування його колізійних норм і з дотриманням будь-яких імперативних норм захисту прав споживачів країни вашого проживання.

15. Apple App Store — додаткові умови

Ці Умови укладені лише між вами та нами, а не з Apple. Apple не несе відповідальності за Застосунок чи його контент. Ви визнаєте, що:

• Apple не зобов'язана надавати будь-яке обслуговування чи підтримку Застосунку.

These Terms of Use ("Terms") are a legal agreement between you and the developer of Dyvo Budget ("we", "us", "our") governing your use of the Dyvo Budget mobile application and its related services (the "App").

By downloading, accessing, or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. The App

Dyvo Budget is a personal-finance app that lets you record accounts, transactions, subscriptions, categories, and budgets, view reports, and optionally share a budget with other people. Financial figures are entered by you; the App does not connect to banks and does not move real money.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) and able to form a binding contract to use the App.

3. Your account

You may use the App as a guest or by signing in with Apple or Google. You are responsible for the activity that occurs under your account and for keeping your sign-in method secure. You are responsible for the accuracy of the information you enter.

4. Free and Pro features

The App offers free features and a paid Dyvo Budget Pro upgrade. Free features include personal budgeting, manual transactions, accounts, categories, subscriptions, and the current-month report. Pro unlocks additional features such as shared budgets and advanced reports. We may change which features are free or Pro, and we will not remove access to Pro features you have already paid for during your paid period.

5. Subscriptions, purchases, and auto-renewal

Dyvo Budget Pro is available as an auto-renewable subscription or as a one-time purchase, sold through the Apple App Store. Titles, durations, and example prices:

* Prices are shown in US dollars as examples. The App Store automatically displays and charges the actual price in your local currency, which may differ, plus any applicable taxes.

The following terms apply to auto-renewable subscriptions, in accordance with Apple's requirements:

• Payment will be charged to your Apple Account at confirmation of purchase.
• Auto-renewal: the subscription automatically renews for the same period at the same price unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Renewal charge: your Apple Account is charged for renewal within 24 hours before the end of the current period, at the price of the selected plan.
• Managing and cancelling: you can manage your subscription and turn off auto-renewal in your Apple Account settings (Settings → your name → Subscriptions) after purchase.
• Free trial: if a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription that covers the same content.
• One-time purchase: the Pro Lifetime option is a single non-consumable purchase that does not renew and is not charged again.

Refunds for App Store purchases are handled by Apple in accordance with Apple's policies; requests are made through Apple. Restoring purchases is available in the App via "Restore purchase".

6. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, as permitted by the Apple App Store Terms of Service (the "Usage Rules"). This license is the "Licensed Application" license described in Apple's Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula), which applies to the App except where these Terms are more protective of us.

7. Acceptable use

You agree not to: (a) use the App for any unlawful purpose; (b) reverse engineer, decompile, or attempt to extract source code except as permitted by law; (c) interfere with or disrupt the App or its servers; (d) attempt to access data of other users; or (e) upload content that is unlawful or infringes others' rights.

8. User content and shared budgets

You retain ownership of the data you enter. You grant us the limited right to store, process, and sync that data solely to operate the App for you. If you use shared budgets, you are responsible for what you share and for inviting only people you trust; content in a shared budget is visible to its members.

9. Intellectual property

The App, its design, and its content (excluding your data) are owned by us and our licensors and are protected by intellectual-property laws. These Terms do not grant you any rights in our trademarks or branding.

10. Not financial advice; disclaimers

Dyvo Budget is a tool for tracking your own finances. It does not provide financial, investment, tax, or legal advice, and its reports and calculations are for informational purposes only. Currency conversions rely on third-party rates and may not be exact. The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or savings, arising out of or related to your use of (or inability to use) the App. Our total liability for any claim relating to the App will not exceed the amount you paid us for the App in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Termination

You may stop using the App at any time. We may suspend or terminate your access if you breach these Terms or misuse the App. Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.

13. Changes to these Terms

We may update these Terms from time to time. Material changes take effect when we post the updated Terms and update the "Last updated" date; continued use of the App means you accept them.

14. Governing law

These Terms are governed by the laws of the country where the developer is established, without regard to its conflict-of-laws rules, and subject to any mandatory consumer-protection laws of your country of residence.

15. Apple App Store — additional terms

These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content. You acknowledge that:

• Apple has no obligation to furnish any maintenance or support for the App.
• In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our responsibility.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to the App, including product-liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer-protection or similar legislation.
• We, not Apple, are responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App or your use of it infringes that party's intellectual-property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting", and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right (and are deemed to have accepted the right) to enforce these Terms against you.
